GENERAL: By checking the "I agree to the Terms and Conditions" box on the buy service page or by using the ThePureLanguage.com Web Site (the "Site") and or other services provided by ThePureLanguage.com (the "Service" or "Services"), you agree to be bound by the ThePureLanguage.com Services Agreement Terms and Conditions (the "Agreement" or "Terms and Conditions") and the ThePureLanguage.com Privacy Policy, referred to collectively as the "Rules". Please read the Rules before activating an account with ThePureLanguage.com or using the ThePureLanguage.com Web site. If you do not agree to the Terms and Conditions and to be bound by the Rules you should not signup and/or login and/or discontinue your use of the ThePureLanguage.com services. Your ThePureLanguage.com account will not be activated or your Service will be terminated or your membership time will expire, as applicable. Your continued use of ThePureLanguage.com Services after the posting of any such change constitutes your acceptance of all the changes. This Agreement is hereby entered into between ThePureLanguage.com and the party executing this Agreement ("Subscriber") on the following terms and conditions. Whereas ThePureLanguage.com provides web site translation Services and other Services and the subscriber wishes to use ThePureLanguage.com (2137378 Ontario Inc.) Services, the parties agree as follows:

PAYMENT: You agree to pay to ThePureLanguage.com (2137378 Ontario Inc.) the charges for the Service plan you select using a valid payment method together with complete, accurate and up-to-date information required on the PayPal order form pages and ThePureLanguage.com pages. All payments must be in US Dollars (USD). ThePureLanguage.com (2137378 Ontario Inc.) reserves the right to reject any payment or order. Your Service subscription starts the day we receive your payment. Charges are billed in advance at the start of the applicable period of Service, in accordance with the prices, plans and terms in effect at time of billing as posted on ThePureLanguage.com's  Web site, http://www.thepurelanguage.com

You agree to notify ThePureLanguage.com (2137378 Ontario Inc.) of any billing problems or discrepancies within 60 days after they first appear on your account statement. If you do not bring them to ThePureLanguage.com's (2137378 Ontario Inc.) attention within 60 days, you agree that you waive your right to dispute such billing problems or discrepancies.

TAXES:  GST (for Canadian citizens only) will be added to the subscription cost on payment. You the Subscriber will pay any or all other sales or use taxes including all other local, state, provincial or federal taxes arising out of the use of this ThePureLanguage.com (2137378 Ontario Inc.) Services.

REFUNDS, CREDITS AND CANCELLATIONS: All fee-based Services are based on a fee paid via the Subscriber's credit card or PayPal payment or any other form of payment accepted by PayPal.com. ThePureLanguage.com (2137378 Ontario Inc.) does not issue credits or refunds in the event of a change in services requested or cancellations or non-use or non activation.

YOUR RIGHT TO CANCEL SERVICE: You may cancel or non-renew the Service by contacting . If you cancel the Service, ThePureLanguage.com (2137378 Ontario Inc.) does not issue credits or refunds in the event of a change in services requested or cancellations. You understand and agree that cancellation of your Service subscription is your sole right and remedy with respect to any dispute with ThePureLanguage.com (2137378 Ontario Inc.). This includes, but is not limited to, any dispute involving: (a) any term of this Agreement, or ThePureLanguage.com (2137378 Ontario Inc.) application or enforcement of this Agreement; (b) any policies or practices of ThePureLanguage.com (2137378 Ontario Inc.), or ThePureLanguage.com (2137378 Ontario Inc.)'s application or enforcement of these policies or practices; (c) any Content provided through the Service, or any change in the Content provided; (d) your ability to access or use the Service or any Content; or (e) the fees, applicable taxes, payment methods, or any change to the fees, applicable taxes, or payment methods.

THEPURELANGUAGE.COM RIGHT TO MODIFY OR TERMINATE SERVICE: ThePureLanguage.com (2137378 Ontario Inc.) may modify the terms of this Agreement or the Service including translation content, including but not limited to the pricing thereof or the Content provided, without notice to you. If you decide not to accept the modifications you may elect to cancel the Service. ThePureLanguage.com (2137378 Ontario Inc.) may terminate this Agreement and any Service at any time upon notice to you, or without notice if you violate any term of this Agreement or fail to make payment when due. In the event that ThePureLanguage.com (2137378 Ontario Inc.) terminates this Agreement or the Service, you will be not entitled to refund of amounts you have already paid for any time periods following the effective date of termination. Your obligation to pay accrued charges and fees shall survive any termination of this Agreement. ThePureLanguage.com (2137378 Ontario Inc.) Services. Subject to the Rules, and such other regulations that ThePureLanguage.com (2137378 Ontario Inc.) may adopt from time to time, ThePureLanguage.com (2137378 Ontario Inc.) will provide Subscriber with Fee-based services. ThePureLanguage.com (2137378 Ontario Inc.) retains the right to suspend or terminate use of the ThePureLanguage.com (2137378 Ontario Inc.) Service at any time for any reason, without notice, and nothing herein shall be construed to limit that right.

Although ThePureLanguage.com presently has no plans to discontinue any Services or to change the price of any Services at ThePureLanguage.com, ThePureLanguage.com does not guarantee that it will continue to offer any Service at the current price at ThePureLanguage.com to Subscribers in the future. ThePureLanguage.com (2137378 Ontario Inc.) reserves the right to discontinue or modify the its Services and to change the price of any fee-based Services without notice to the Subscriber other than by disclosure on the ThePureLanguage.com Web site.

PERSONAL INFORMATION: An online account with ThePureLanguage.com is required to purchase and use the Service. Personal information you provide when creating or updating such an account includes your name, email address, passwords, location, billing and payment information.ThePureLanguage.com uses your personal information to verify your access rights to, provide you with, and bill you for, the Service plan you select. Unless disclosure is mandated by law or legal process, ThePureLanguage.com will intentionally disclose your personal information to a third party only if you specifically consent to provide such information to a third party. You understand that ThePureLanguage.com also will collect, store, compile and utilize information about you, your computer and collects and analyzes usage information for the Service and Content, on an anonymous and aggregated basis. ThePureLanguage.com may use or disclose anonymous aggregated usage information to further improve the Service and Content, to determine what Service plans or types of Content are most popular, and for any other purpose not inconsistent with the applicable privacy laws.

ThePureLanguage.com (2137378 Ontario Inc.) does not rent or sell your Personally Identifiable Information to anyone without your express permission. ThePureLanguage.com (2137378 Ontario Inc.) provides fee-based services. By becoming an ThePureLanguage.com (2137378 Ontario Inc.) Subscriber, you agree to receive email communications including alerts, announcements, updates and other carefully screened special offers and promotions. This is essential to maintaining our services to our subscribers. Subscribers may expect to receive no more than four special offers or promotions per month. Subscribers may expect to receive an unspecified and unlimited amount of emails from ThePureLanguage.com (2137378 Ontario Inc.) from to resolve any customer issues and inquiries.

EMAIL NOTIFICATION: In addition to, or in lieu of, any posting on ThePureLanguage.com's Web site, ThePureLanguage.com may notify you by email of modifications to this Agreement, the Service, available Content, or your account. As a Service subscriber, you agree that thepurelanguage.com may send such email to the address you provide. Because such email is necessary for your use or continued use of the Service, you will receive such email even if you have not signed up for, or have opted out of receiving, other email from ThePureLanguage.com.

MINORS: If you are less than 18 years old, you should obtain your parent's permission to use the ThePureLanguage.com Services. If you are a parent permitting a minor to use ThePureLanguage.com Services, you agree to: Exercise supervision over the minor's use of ThePureLanguage.com Services and access to the Internet. Assume all risks associated with the minor's viewing of content received through use of ThePureLanguage.com Services and the minor's transmission of materials, content, or information to another person via the Internet. Assume any and all liabilities resulting from the minor's use of ThePureLanguage.com Services. Ensure to the fullest extent possible the accuracy and truthfulness of all information submitted by the minor in response to ThePureLanguage.com questionnaires, surveys and Activation Forms.

ACTIVATION INFORMATION: You must register for ThePureLanguage.com (2137378 Ontario Inc.) Services using your own name. During activation, you will be asked to provide an email and password you wish to use as your login identification. If the login identification you request is not available you will be asked to supply another login identification. ThePureLanguage.com (2137378 Ontario Inc.) reserves the right to verify the accuracy of the information you submit in connection with your activation for ThePureLanguage.com (2137378 Ontario Inc.) Services (including, without limitation, performing cross tabulations with external databases) and you hereby consent to ThePureLanguage.com (2137378 Ontario Inc.) verification of such information.

ACCURATE AND COMPLETE INFORMATION: You agree to provide ThePureLanguage.com (2137378 Ontario Inc.) with accurate and complete information it may request, from time to time, through questionnaires, surveys and activation forms.

USEAGE RESPONSIBILITIES: You are responsible for all use of your ThePureLanguage.com (2137378 Ontario Inc.) Services and for the security of your login identification, your password and email and any other security lock code that you use to protect access to your data, ThePureLanguage.com personal profile, your file name(s) and files, network and user access, and any information you disseminate through use of ThePureLanguage.com Services or through other Internet services.

NO RESALE OF THEPURELANGUAGE.COM SERVICES OR WEBSITE: The ThePureLanguage.com (2137378 Ontario Inc.) Services are for use of registered Subscribers only and may not be copied, resold, leased, transferred, exchanged or bartered. You must not use this service in any way that causes an unreasonable load on the system or deviates from its intended use. You must not set up any automated programs to interact or act upon our systems without prior written consent from ThePureLanguage.com (2137378 Ontario Inc.). You must not cause an unreasonable or unwanted load on any third party systems. Upon acceptance of these terms, you have a nonexclusive license to use the Service. You agree not to modify, change, disassemble, decompile or otherwise reverse engineer any software or service provided by ThePureLanguage.com (2137378 Ontario Inc.). You must not cause or allow robots or other automated processes to act upon or interact with ThePureLanguage.com's Web site or systems or user interfaces without prior written consent from ThePureLanguage.com (2137378 Ontario Inc.).

NO ASSIGNMENT: Subscriber may not assign, resell, or license this agreement or the Services provided hereunder, without the prior written consent of ThePureLanguage.com (2137378 Ontario Inc.).

USE OF SERVICE AND DATA: Subscribers and all visitors agree that all data generated by the services are for Subscriber's internal use and reference only. If Subscribers use the ThePureLanguage.com (2137378 Ontario Inc.) Services to translate material/text, which Subscriber does not directly own, Subscriber agrees not to publish or otherwise disclose the translation acquired.

LINKS TO THIRD PARTIES: The ThePureLanguage.com (2137378 Ontario Inc.) Site contains links to other sites on the Internet that are owned and operated by third parties. In some instances these sites are co-branded and the third parties are entitled to use ThePureLanguage.com (2137378 Ontario Inc.) name and logo on these sites. ThePureLanguage.com (2137378 Ontario Inc.) does not control the information, products, or services on these third party sites. The inclusion of any link does not imply endorsement by ThePureLanguage.com (2137378 Ontario Inc.) of the site or any association with their operators. Because ThePureLanguage.com (2137378 Ontario Inc.) has no control over such sites and resources, you agree that ThePureLanguage.com (2137378 Ontario Inc.) is not responsible or liable for the availability or the operation of such external sites, for any material located on or available from any such sites, or for the protection of your privacy data by third parties. Any dealings with or participation in promotions of advertisers on our Service, including the payment and delivery of related goods or services, and any other terms, conditions, warranties, or representations associated with such dealings or promotions, are solely between you and the advertiser or other third party. LIMITATION OF LIABILITY: All Subscribers are required to abide by the Rules. By activating an account, you become a Subscriber. You then agree to indemnify and hold harmless ThePureLanguage.com (2137378 Ontario Inc.) for any loss, liability, and damage arising from or in connection with the contents or service of any ThePureLanguage.com Service. ThePureLanguage.com is not responsible, directly, indirectly or consequentially, for the content or the suitability or accuracy of the information contained on the ThePureLanguage.com web site or the suitability or accuracy of the translation generated by ThePureLanguage.com web site. ThePureLanguage.com has exercised reasonable care to ensure that the translation generated by ThePureLanguage.com is reasonably correct based on the ThePureLanguage.com team's personal knowledge and reference material available, but ThePureLanguage.com does not guarantee that the translation generated is accurate or correct in any way. ThePureLanguage.com (2137378 Ontario Inc.) does not accept liability for any damage direct, indirect or consequential for the use of the services or information associated with services provided by ThePureLanguage.com nor does ThePureLanguage.com (2137378 Ontario Inc.) accept any responsibility and / or liability, directly, indirectly, or consequentially, for failures, programming errors, loss of information, omissions or inaccuracies with regard to the translation service and other ThePureLanguage.com services.ThePureLanguage.com (2137378 Ontario Inc.) does not accept any responsibility to maintain, host, backup your personal word list and is not responsible for loss of data, corruption of data, or accidental deletions to this information and no backup or restore from backup service will be provided. ThePureLanguage.com (2137378 Ontario Inc.) shall not be liable for non-performance or delay in performance caused by any reason, whether within or outside of its control. ThePureLanguage.com (2137378 Ontario Inc.) disclaims all warranties, expressed or implied, including warranties of merchantability or fitness for a particular purpose in connection with this.

The Subscriber agrees that ThePureLanguage.com (2137378 Ontario Inc.) is not liable for any monetary amount with regard to the ThePureLanguage.com translation Service or any other ThePureLanguage.com Services. The subscriber agrees that ThePureLanguage.com is not liable for any monetary amount in excess of the fees paid to ThePureLanguage.com (2137378 Ontario Inc.) by the Subscriber. In no event shall ThePureLanguage.com (2137378 Ontario Inc.) be liable, whether in contract, tort (including negligence) or otherwise, for any indirect, incidental or consequential damages (including lost savings or profit, lost data or business interruption even if ThePureLanguage.com is notified in advance of such possibility. This includes damages incurred by the subscriber, the subscriber's own customers or any third party. 

IN NO EVENT SHALL THEPURELANGUAGE.COM (2137378 ONTARIO INC.) OR ITS SUBSIDIARIES, AFFILIATES OR SUPPLIERS BE  LIABLE UNDER ANY SECTION OF THESE TERMS AND CONDITIONS OR UNDER CONTRACT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER LEGAL OR EQUITABLE THEORY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF USE, LOST PROFITS, LOSS OF DATA OR INFORMATION OF ANY KIND OR LOSS OF BUSINESS GOODWILL OR OPPORTUNITY) OR OTHER DAMAGES WHATSOEVER, WHATSOEVER ARISING OUT OF THIS AGREEMENT, OR THE USE OF OR INABILITY TO USE OR THE RESULTS OF USING THE SERVICE OR THE CONTENT, EVEN IF THEPURELANGUAGE.COM (2137378 ONTARIO INC.) HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THEPURELANGUAGE.COM (2137378 ONTARIO INC.) SHALL NOT BE LIABLE FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS, SERVICES OR TECHNOLOGY. YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISPUTE WITH THEPURELANGUAGE.COM (2137378 ONTARIO INC.) RELATED TO THIS AGREEMENT OR THE SERVICE OR CONTENT SHALL BE CANCELLATION OF THE SERVICE. IN THE EVENT A COURT AWARDS DIRECT DAMAGES IN SPITE OF THE FOREGOING, YOU AGREE THAT SUCH DAMAGES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE. NO ACTION, REGARDLESS OF FORM, ARISING OUT OF THESE RULES OR OUT OF THE THEPURELANGUAGE.COM (2137378 ONTARIO INC.) SERVICES MAY BE BROUGHT BY YOU OR THEPURELANGUAGE.COM (2137378 ONTARIO INC.) MORE THAN ONE (1) YEAR AFTER THE EVENT, WHICH GAVE RISE TO THE CAUSE OF ACTION, HAS OCCURRED. SOME JURISDICTIONS DO NOT ALLOW A LIMITATION ON LIABILITY FOR NEGLIGENCE THAT CAUSES DEATH OR PERSONAL INJURY AND, IN SUCH JURISDICTIONS, THEPURELANGUAGE.COM (2137378 ONTARIO INC.)'S LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW. Some jurisdictions do not allow the limitation of liability for incidental or consequential damages, so the aforementioned limitation may not apply to you.

WARRANTY DISCLAIMERS: YOU ACKNOWLEDGE THAT THEPURELANGUAGE.COM (2137378 ONTARIO INC.) SERVICES AND CONTENT ARE PROVIDED "AS IS, AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND WHETHER, ORAL OR WRITTEN, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY WITH RESPECT TO THE QUALITY, PERFORMANCE OR FUNCTIONALITY OF THE THEPURELANGUAGE.COM (2137378 ONTARIO INC.) SERVICES OR WITH RESPECT TO THE QUALITY OR ACCURACY OF ANY TRANSLATION OR INFORMATION OBTAINED FROM OR AVAILABLE THROUGH USE OF THEPURELANGUAGE.COM (2137378 ONTARIO INC.) SERVICES OR THAT THEPURELANGUAGE.COM (2137378 ONTARIO INC.) SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. THEPURELANGUAGE.COM (2137378 ONTARIO INC.) DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF QUIET ENJOYMENT AND NON-INFRINGEMENT AND ANY IMPLIED WARRANTIES OF MERCHANTABILITY, WARRANTIES OF TITLE, FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY OF COMPUTER PROGRAMS AND INFORMATIONAL CONTENT, PRODUCTS OR SOFTWARE SOLD OR OTHERWISE MADE AVAILABLE ON THIS SITE. THEPURELANGUAGE.COM (2137378 ONTARIO INC.) IS PROVIDING A SERVICE REMOTELY VIA THE INTERNET AND MULTIPLE PUBLIC AND PRIVATE FACILITIES, SOME OF WHICH ARE NOT WITHIN OUR CONTROL. THE COMPANY DOES NOT GUARANTEE THE QUALITY OR CONDITION OF THE SERVICE. THEPURELANGUAGE.COM (2137378 ONTARIO INC.) DOES NOT GUARANTEE YOUR SERVICES WILL BE ACTIVE AND AVAILABLE 100% OF THE TIME AND WILL NOT BE HELD LIABLE FOR ANY LOSSES IN THE EVENT THAT THERE IS A SERVICE FAILURE. TO THE MAXIMUM EXTENT ALLOWED BY LAW, THEPURELANGUAGE.COM (2137378 ONTARIO INC.)  AND ITS SUBSIDIARIES, AFFILIATES AND SUPPLIERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. USE OF THE SERVICE OR CONTENT IS ENTIRELY AT YOUR OWN RISK. Some jurisdictions do not allow the exclusion of implied warranties or conditions, so the aforementioned exclusion may not apply to you.

INDEMNIFICATION OF THEPURELANGUAGE.COM (2137378 ONTARIO INC.): YOU AGREE TO DEFEND, INDEMNIFY AND HOLD THEPURELANGUAGE.COM (2137378 ONTARIO INC.) AND ITS SPONSORS, ADVERTISERS, PARTNERS OR OTHER CO-BRANDERS AND AFFILIATES HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, DAMAGES, LIABILITIES AND COSTS (INCLUDING, WITHOUT LIMITATION, REASONABLE ATTORNEYS' FEES AND COURT COSTS) (COLLECTIVELY, "CLAIMS") ARISING OUT OF OR RELATING TO YOUR BREACH OF ANY OF THESE RULES OR USE (BY YOU OR ANY THIRD PARTY) OF THEPURELANGUAGE.COM (2137378 ONTARIO INC.) SERVICES THROUGH THE THEPURELANGUAGE.COM ACCOUNT ASSIGNED TO YOU. THE FOREGOING INDEMNIFICATION OBLIGATION SHALL SURVIVE ANY TERMINATION OF THEPURELANGUAGE.COM (2137378 ONTARIO INC.) SERVICES PROVIDED TO YOU.

USAGE RESTRICTIONS: You may only use the Service and Content for private, non-commercial purposes in compliance with applicable laws in the jurisdictions in which you use the Service and Content, including, but not limited to, restrictions concerning copyright and other intellectual property rights. Under no circumstances may you: (a) modify the source list in any way, or use this service through another web site (through a frame, iframe, window or any other means from/through another web site); (b) rent, lease, or distribute the Service or Content to third parties; or (c) broadcast or perform the Service or Content outside of your normal circle of family and friends. You may not share your account information and passwords, or permit others to use your account to access the Service or Content by any means. You may not, by means of any device, software, or other method, attempt to circumvent technological measures controlling access to, or the rights in, the Service or Content or attempt to copy the source list. The Service and Content are intended for use only with properly licensed devices and software and internet browsers. It is entirely your responsibility to determine what copyright, patent or other licenses are required, and to obtain any such licenses, in order to access the Service and Content. You understand that upon any cancellation, expiration or termination of this Agreement (whether by you or ThePureLanguage.com), your license to the Service and Content also terminates, and you shall immediately discontinue all further use of the Service.

NO WAIVER: Any failure of ThePureLanguage.com (2137378 Ontario Inc.) to enforce any provision of these Rules shall not constitute a waiver of any rights under such provision or any other provision of these Rules.

FORCE MAJEURE: Except for Subscriber's payment obligations, neither party will be liable for any failure or delay in performing any obligation under this agreement that is due to causes beyond its reasonable control, such as natural catastrophes, government acts or omissions, laws or regulations, labor strikes, communications systems breakdowns, hardware or software failures, transportation stoppages or slowdowns, or the inability to procure supplies or materials.

This Agreement will not be governed by the United Nations Convention of Contracts for the International Sale of Goods, the application of which is hereby expressly excluded. Each party consents to the exclusive venue and jurisdiction of the appropriate courts in Ontario Canada for any disputes under this agreement.

SEVERABILITY: If any provision of these Rules is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to comply with applicable laws, and the remainder shall remain in full force and effect. Failure to enforce any provision of this Agreement, on any one occasion, will not affect the right to enforce other provisions, or the same provision on another occasion.

ENTIRE AGREEMENT AND MODIFICATIONS: The terms of this Agreement constitute the entire agreement between ThePureLanguage.com (2137378 Ontario Inc.) and the Subscriber regarding its subject matter and its terms supercede any prior or simultaneous agreement or terms, whether oral or written. Except as provided herein, any waiver, modification, or amendment of any provision of this Agreement will be effective only if in writing and signed by the parties herein. ThePureLanguage.com (2137378 Ontario Inc.)  provision of Service to you is expressly made conditional on your acceptance of the terms set forth herein.
